Malaysian Disciplinary Procedure Workshop

Introduction

There are times when errant employees must be disciplined failing which employers may risk losing the loyalty of their good and productive workers. Today, this is no longer a simple task as employers face a number of constraints, such as the inalienable right of the employee to be heard and the limitation of employers to do as they choose.

Before a severe punishment is meted out, a domestic inquiry is recommended. The importance of knowing how to conduct a proper inquiry cannot be over emphasized since the cost of a poorly conducted domestic inquiry, or worse still, not conducting one, can prove to be extremely high to the company.

It is often held that employees receive favoured treatment at the Industrial Court, but this so-called 'protection' arises not because the employee is right but more so because the process implemented by the employer was not.

This workshop aims to provide a working knowledge and understanding of the laws relating to misconduct, the requirements and methodology of investigating misconduct and conducting a domestic inquiry so that employers get it right the first time, thus avoiding costly litigation arising from the mishandling of a misconduct.
