- Unfair Dismissal

During these trying times, HR people here should be aware of unfair dismissal, wrongful dismissal or constructive dismissal. This occurs when the company takes certain actions which "forces" the employee to resign. Some of the actions could include:

  • Harassment,

  • Bullying,

  • Humiliation,

  • Salary reduction, or

  • Change in working conditions
  • Some companies may feel that they need not pay redundancy or retrenchment benefits in such circumstances. We would like to advise them to carefully consider the legal and long-term implications of their decisions.
